These Terms of Service ("Terms") govern your use of the Moxy mobile application ("the App", "Moxy", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Moxy is a self-help and wellness application that provides guided anxiety management techniques based on the DARE framework, including mood tracking, journaling, breathing exercises, and grounding techniques. The App is designed to support general well-being and personal development.
Moxy is not a medical device, medical application, or healthcare service. The App does not provide medical advice, diagnosis, treatment, or therapy of any kind. The content, techniques, and exercises provided in the App are for general informational and self-help purposes only.
By using this App, you acknowledge and agree that:
You must be at least 13 years of age to use the App. If you are under 18, you represent that you have obtained consent from a parent or legal guardian to use the App. By using the App, you represent and warrant that you meet these requirements.

All personal data you enter into the App (including mood entries, journal entries, and onboarding responses) is stored exclusively on your device. We do not collect, transmit, or have access to this data. For full details, please refer to our Privacy Policy.
You are solely responsible for maintaining the security of your device and any data stored on it. We are not responsible for any unauthorized access to your device or the data stored therein.
Moxy is a paid application. Your purchase is processed by Apple through the App Store and is subject to Apple's terms and conditions. We do not collect or have access to your payment information.
Refund requests must be submitted to Apple directly in accordance with Apple's refund policies. We do not have the ability to issue refunds for App Store purchases.
All content, design, graphics, text, exercises, techniques, and other materials in the App are owned by us or our licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
The DARE framework referenced in the App is based on publicly available self-help methodologies. Our implementation, presentation, and specific content are our original work.
To the fullest extent permitted by applicable law, the App is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, we do not warrant that:

In no event shall our total aggregate liability exceed the greater of (a) the amount you actually paid us for the App or subscription in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100 USD).
You agree to indemnify, defend, and hold harmless Moxy and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms within the App or on our website. The "Last updated" date at the top of this page will reflect the most recent revision. Your continued use of the App after any changes constitutes acceptance of the modified Terms.
We reserve the right to suspend or terminate your access to the App at any time, for any reason, without prior notice. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to disclaimers, limitations of liability, and indemnification.
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Norway, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Norway.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moxy regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.
